2024年12月13日，美國國際貿(mào)易委員會(ITC)投票決定對特定帶彩色外底的女式平底鞋(Certain Women’s Flats with Colored Outsoles Thereof)啟動337調(diào)查(調(diào)查編碼：337-TA-1428)。

　　2024年11月13日，美國Gavrieli Brands LLC of Culver City,California向美國ITC提出337立案調(diào)查申請，主張對美出口、在美進口和在美銷售的該產(chǎn)品違反了美國337條款(侵權(quán)美國設(shè)計專利D681,928、D844,950、D844,951、D681,927、D781,035、D781,032、D686,812、D688,853)，請求美國ITC發(fā)布普遍排除令或有限排除令、禁止令。

　　美國Kijera’s OneDrop LLC of New York,NY、菲律賓Craze of Philippines、中國廣東Pierjeda Information Technology Co.,Ltd.of China廣州皮爾吉達信息技術(shù)有限公司、中國福建Shengze Trading Company of China、中國廣東Guangzhou Shun Cheng Trading Co.,Ltd.of China廣州順宬貿(mào)易有限公司、中國云南Kunming Ouxiang Trading Co.,Ltd.of China昆明甌相商貿(mào)有限公司、中國北京Huihui Bianan of China、中國廣東Bingxin Qingfeng of China、中國廣東Baiqiuju1983 of China、中國廣東tb249835650 of China、中國廣東Yuyoufang Foreign Trade Store of China、中國廣東Xu Wenping 123 of China、中國北京Ynwll of China為列名被告。

　　美國國際貿(mào)易委員會將于立案后45天內(nèi)確定調(diào)查結(jié)束期。除美國貿(mào)易代表基于政策原因否決的情況外，美國國際貿(mào)易委員會在337案件中發(fā)布的救濟令自發(fā)布之日生效并于發(fā)布之日后的第60日起具有終局效力。
